How We Choose Cases

Earthjustice attorneys are asked to undertake far more cases than time and resources permit. Questions we ask to help us choose the cases that will make the most difference include:
- What is the natural resource involved in the case?
- Are other environmental organizations and/or community groups interested in joining our coalition?
- Does the case provide an opportunity to set a precedent by creating good case law that can be useful in other efforts?
- Is there a fair chance we can win the case in court?
- How much public support exists for the position we advocate? It must be sufficient in case we need to address attempts to undo our courtroom victories in Congress or the state legislatures.
